KONU: GENEL KURUL TOPLANTISI HAKKINDA

Bodrum Kaymakamlığına Genel Kurul toplantısı yapıp yapamayacağımı netleştirmek amacıyla 30.03.2021 Salı günü bir yazı yazdım. Bodrum Kaymakamlığı’nın 02.04.2021 günü verdiği cevap “Muğla valilik makamının 30.03.2021 gün ve 2021/11 sayılı Hıfzıssıhha kurulu kararı gereği sitelerin genel kurullarının ertelendiğine dair kısıtlamadan bahsedilmediğinden Genel kurul toplantınızın yapılıp / yapılmamasında serbestsiniz “şeklinde olmuştur.
Bunun üzerine Genel kurul toplantısı için gerekli hazırlıklar yapılmış ve kat mülkiyet kanununun belirttiği kanuni süre kadar öncesinden kat maliklerine toplantı detayları bildirilmişti.
Muğla ili hıfzıssıhha meclisi kurulunun 02.03.2021 tarih ve 2021/06 kararı gereğince genel kurul toplantısı yapılacağı en az 3 gün önce Valiliğe (Kaymakamlığa) bildirilecek denildiği için bodrum kaymakamlığına ekte bilgilerinize sunulan 2. Yazı yazılmıştır. Bu yazıya bodrum kaymakamlığı 18.05.2021 tarihinde verdiği cevapta Genel kurul toplantılarının 01.06.2021 tarihine kadar ertelendiğini bildirmiştir. Kısaca daha önce yapabilirsin dediği genel kurul toplantısı için bu kez yapamazsın demiştir.
Yukarıda izaha çalıştığım durum sebebiyle 24.05.2021 tarihinde yapılması gereken genel kurul toplantımız iptal edilmiştir. Yeni toplantı tarihi ileride açıklanacak tedbirlere göre belirlenecek ve kat maliklerine yasaların emrettiği biçimde bildirilecektir.

SUBJECT: ABOUT GENERAL ASSEMBLY MEETING
Dear Property Owner;
I wrote a letter to Bodrum District Governorship on Tuesday, 30.03.2021 to clarify whether I can hold a General Assembly meeting. The answer given by the Bodrum District Governorship on 02.04.2021 was "You are free to hold/not to hold your General Assembly meeting, since there is no mention of the restriction of postponing the general assemblies of the sites in accordance with the decision of the Muğla Governorship’s Office dated 30.03.2021 and numbered 2021/11".
Upon this, the necessary preparations were made for the General Assembly meeting and the meeting details were notified to the property owners within the legal period specified by the property ownership law.
In accordance with the decision of the Muğla Province Sanitary Council Board dated 02.03.2021 and numbered 2021/06, it is stated that the general assembly meeting should be notified to the Governorship (District Governorship) at least 3 days before the meeting date, so the second letter which is submitted enclosed to your information, was written to Bodrum District Governorship. In the reply given by Bodrum District Governorship to this letter on 18.05.2021, it was notified that the General Assembly meetings were postponed until 01.06.2021. Briefly, they said that we cannot hold the general assembly meeting even though previously they had said we could.
Due to the situation I tried to explain above, our general assembly meeting, which had to be held on 24.05.2021, is canceled. The new meeting date will be determined according to the measures to be announced in the future and the property owners will be notified as ordered by the laws.
